USER AGREEMENT

1. Parties

This Website Usage Agreement ("User Agreement") is prepared at the moment of approval by the User when entering and/or becoming a member of the Website between the user who accesses the Website and/or becomes a member and Mets Villa and Yat İşletmeciliği Turizm Tic. Ltd. Şti., which operates the Website. The User acknowledges and declares that they have read the entire User Agreement, understood its content entirely, and accepted and declared their approval of all its provisions by entering the Website and/or becoming a member.

1. Definitions

• Mets Villa and Yat İşletmeciliği Turizm Tic. Ltd. Şti.: Pafta'm Bodrum

• Site: Refers to the Website consisting of the domain name www.paftam.com and its subdomains.

• Buyer: Refers to the user who purchases the goods and/or services offered for sale by the Seller by using the services provided on the Website.

• Content: All publicly available data such as visual, auditory, written information, along with open data such as logos, signatures, files, music, etc.

• Service: Refers to the applications presented within the Website by Pafta'm Bodrum to enable Users to perform the transactions defined in the User Agreement.

• User/Member: Refers to the real or legal person who enters the Website and/or becomes a member and benefits from the services offered on the Website under the conditions specified in this User Agreement. Sellers and Buyers become Users on the Website.

1. Subject and Scope of the Agreement

3.1 The subject of the User Agreement is to determine the terms and conditions for using the services offered on the Website, as well as the rights and obligations of the parties.

3.2 The scope of the User Agreement includes all warnings, writings, and explanations made by Pafta'm Bodrum within the Website, related to the use, membership, and services, along with the User Agreement and its annexes.

3.3 By accepting the provisions of the User Agreement, you also agree to comply with all statements made by Pafta'm Bodrum within the Website regarding the use, membership, and services, and to act in accordance with these statements.

1. Membership and Service Usage Conditions

4.1 Membership is completed by the person who wants to become a User on the Website by sending the necessary identity information to the relevant section of the Website and completing the registration process approved by Pafta'm Bodrum. The right and authority to become a User defined in this User Agreement cannot be obtained without completing the membership process.

4.2 To become a member of the Website, it is necessary to be of legal age and not to have been temporarily suspended or permanently banned from membership by Pafta'm Bodrum. The completion of the registration process on the Website by individuals who are not of legal age or who have been temporarily suspended or permanently banned from membership by Pafta'm Bodrum, as mentioned in Article 5.2 of this User Agreement, will not result in their membership in the Website.

1. Rights and Obligations

5.1 Rights and Obligations of the User

5.1.1 The User agrees, declares, and undertakes to comply with all the terms specified in the User Agreement, the rules stated in the relevant sections of the Website, and all applicable legislation when fulfilling the membership procedure, benefiting from the services of the Website, and performing any transaction related to the services on the Website. The User acknowledges and declares that they understand and approve all the conditions and rules mentioned above.

5.1.2 In cases where it is claimed that the rights of third parties, including but not limited to copyright, trademark, commercial title, are violated due to the content shared by the User, the User acknowledges that Pafta'm Bodrum is authorized to disclose their confidential/private/commercial information to official authorities and right holders, and therefore, no compensation can be claimed from Pafta'm Bodrum under any name.

5.1.3 The security, storage, keeping away from the knowledge of third parties, and use of access tools (username, password, etc.) used by the Users to access the system for the purpose of benefiting from the services offered by Pafta'm Bodrum are entirely the responsibility of the Users. Pafta'm Bodrum shall not be held directly or indirectly liable for any damages incurred by the Users and/or third parties due to the negligence and faults of the Users regarding the security, storage, keeping away from the knowledge of third parties, and use of access tools.

5.1.4 Users accept, declare, and undertake that the information and content provided by them on the Website are accurate and legal. Pafta'm Bodrum does not guarantee or undertake to investigate the accuracy of the information and content transmitted to Pafta'm Bodrum by the Users or uploaded, modified, or provided by them on the Website, or to guarantee the security, accuracy, and legality of such information and content. Pafta'm Bodrum shall not be held responsible for any damages that may arise due to the incorrect or faulty nature of such information and content.

5.1.5 Without the written consent of Pafta'm Bodrum, Users cannot transfer their rights and obligations within the scope of the User Agreement, either partially or completely, to any third party.

5.1.6 Users who benefit from the services offered by Pafta'm Bodrum and use the Website can only perform transactions on the Website for lawful purposes. The legal and criminal responsibility for every action and transaction made by Users on the Website is their own. Each User agrees, declares, and undertakes not to reproduce, copy, distribute, process, or in any way compete with Pafta'm Bodrum directly and/or indirectly, both through these actions and in any other way, the images, texts, visual and auditory images, video clips, files, databases, catalogs, and lists on the Website in a way that would violate the intellectual or personal rights or property of Pafta'm Bodrum or any third party.

5.1.7 Pafta'm Bodrum shall not be held responsible for services provided and contents published on the Website by third parties, including Users. The accuracy and legality of the information, content, visual and auditory images provided and published by third parties on the Website are entirely the responsibility of the individuals who perform these actions. Pafta'm Bodrum does not guarantee the security, accuracy, and legality of the services and contents provided by third parties, including Users, on the Website.

5.1.8 Users, including Users and their relatives on the Website, agree, declare, and undertake not to perform transactions that will allow money transfer between their own memberships and memberships of their relatives on the Website and not to manipulate the operation of the Website. Otherwise, Users accept, declare, and undertake to compensate for any damage that Pafta'm Bodrum may suffer.

5.2 Rights and Obligations of Pafta'm Bodrum

5.2.1 Pafta'm Bodrum reserves the right to change the services and content offered on the Website at any time and may close access to the information and content uploaded by Users to the system, including Users, to third parties and delete them. Pafta'm Bodrum can use this right without any prior notice. Users immediately comply with the changes requested by Pafta'm Bodrum.
